Property Transfer in Dubai: The DLD Process, Fees and Paperwork

A Dubai property transfer is a defined sequence involving the developer, the Dubai Land Department and a registration trustee. This guide sets out each stage, the fees to budget for, and what changes when a mortgage or a family gift is involved.

Who is involved

Three parties matter. The developer issues the no objection certificate confirming service charges are settled. The Dubai Land Department owns the register and issues the title deed. A registration trustee office runs the appointment where the parties attend, payment is verified and the transfer is recorded.

The standard cash transfer, stage by stage

01

Memorandum of understanding

Buyer and seller sign the sale agreement, commonly Form F, and the buyer places the agreed deposit with the agent or trustee.

02

Developer no objection certificate

The developer confirms service charges are clear and issues the NOC. This is usually the slowest single step, so apply early.

03

Trustee appointment

Both parties, or their attorneys under a registered power of attorney, attend the trustee office with originals.

04

Payment and verification

The balance is paid by manager's cheque made out to the seller, which the trustee verifies at the counter.

05

Title deed issuance

The Dubai Land Department records the change and issues the new title deed, usually the same day.

06

Utilities and handover

DEWA and cooling accounts are transferred, keys and access cards are handed over, and any tenancy is assigned.

Fees to budget for

Service charges are apportioned between the parties at the transfer date, so ask for the current statement before the appointment rather than after it.

When a mortgage is involved

If the seller has a loan, it must be settled and the bank's mortgage released before or at the transfer. If the buyer is financing, the lender's final offer letter must be in place and the lender attends or is represented at the trustee office. Coordinating a seller's release and a buyer's new mortgage on the same day is normal practice but needs the sequence agreed with both banks in advance.

Gift transfers between relatives

Transfers between first degree relatives, typically parent to child or between spouses, are registered as gift transfers and attract a reduced Dubai Land Department fee. Proof of relationship is required through attested birth or marriage certificates, translated into Arabic. Company to shareholder transfers follow a different route again and are assessed on their own facts.

What delays transfers

  • Outstanding service charges, which block the developer NOC.
  • An unreleased mortgage on the seller's side discovered late in the process.
  • A power of attorney that does not name the specific property and the power of sale.
  • Manager's cheques made out incorrectly or dated wrongly.
  • A sitting tenant whose notice position has not been resolved.
  • Passport name variations between the title deed and current identification.

Frequently asked

Do buyer and seller both have to attend?

Yes, in person or through an attorney acting under a registered power of attorney that names the property and the power to sell or purchase.

Can a non resident buy property in Dubai?

Yes, in designated freehold areas. Residency is not a requirement to own, though a UAE bank account makes payment and service charges easier to manage.

How long does a transfer take?

Once the developer NOC is issued, the trustee appointment and title deed can complete the same day. Getting to that point typically takes two to six weeks.

Is the transfer fee negotiable between the parties?

The fee itself is fixed by the Dubai Land Department, but which party pays it is a matter of agreement recorded in the sale contract.
